It is an offence under the Environmental Protection Act 1990 to emit light from a premise which is obtrusive and therefore prejudicial to health or a nuisance.

What can you do if you are affected by neighbours light?

What happens next?

An officer will contact you and arrange for an out of hours officer to visit you when the problem occurs.

Once the problem has been independently witnessed the officer will send an informal letter to the offender outlining the problem and the steps they should take to remedy the nuisance.

A letter was sent but the problem is still ongoing?

If the offender fails to resolve the problem you will be asked to keep a log of the nuisance, this will include the date, time, and length of time the light was a nuisance.  An officer will also visit to witness the problem.

Once a nuisance has been established the offender will be issued with a formal notice requiring them to carry out specific works to remedy the nuisance.  If the offender fails to comply with the notice they may face prosecution.
