Aims This course aims to enable participants already familiar with the Mental Capacity Act to maximise their skills in assessing mental capacity for people with psychosis. It provides an in-depth analysis of the assessment of capacity and considers the latest case law. Learning outcomes • Enhance skills in assessing mental capacity for people with psychosis • Understand key lessons from case law for assessing capacity • Identify situations that require Court of Protection authority • Apply learning into practice through case study scenarios Programme The course will include the following key topics: • Mental Capacity Act 2005 – brief overview • Consent > Mental capacity > Duty of care > Human rights • Defining and assessing mental capacity – brief overview • Presumption of mental capacity and the link to consent • Unwise decisions – limits and application • Consequence of poor assessments - lessons from safeguarding reviews • Practical issues and challenges in assessing capacity: when to assess, frequency, reviews, who should assess, refusals to be assessed, disputes • Psychosis – what is it and what are the symptoms? • Use or weigh in practice for people with symptoms of psychosis • Case studies to apply learning to practice • Record keeping – evidence and practical tips • Fluctuating capacity – recent case law examples • MHA admissions, decisions regarding psychiatric admissions and issues for AMHPs and assessing doctors. • Best interests overview – decision making for those lacking capacity
