Provider Funding Agreement 2023 - 2024

These terms and conditions set out the expectations between Coventry City Council (“the Council”) and (“Provider”) and refers to early year’s provision free of charge (sections 7 and 7A of the Childcare Act 2006) and free childcare (section 2 of the Childcare Act 2016) as the ‘free entitlement(s)’ or ‘free hours’ or a ‘free place’.

These terms apply to the 15 hour entitlement for the most disadvantaged two year olds, the 15 hour entitlement for parents of three and four year olds (the universal entitlement) and the additional 15 hours entitlement for working parents of three and four year olds (the extended entitlement). In addition to these, Disability Access Funding (DAF) and Early Years Pupil Premium (EYPP).

The Provider Agreement is for:

  • Local authorities
  • Early years providers who are referred to as ‘Providers’ and include:
  • Early years providers and childminders registered on the Ofsted Early Years Register;
  • Childminders registered with a childminder agency that is registered with Ofsted;
  • Independent Schools and Academies taking children age two and over and which are exempt from registration with Ofsted as an early years provider.

The Parent and Carer Agreement is for:

  • Early years Providers, as set out above
  • Parents

The Council is committed to the delivery of high quality Early Education Places through supporting and monitoring provision in the city.

The Council and the Provider have agreed to enter into this agreement in order to provide the service of Early Education Places.

The Agreement shall come into effect on 1 September 2023 until 31 August 2024 unless terminated early in accordance with the terms of the Agreement.

Eligibility Route 1

Eligibility Route 2

2-year-olds may also get free childcare if they:

  • are looked after by a local authority, for example a Foster Carer – proof of evidence will be required, such as– A letter from a relevant professional with the child`s name and date of birth.
  • have an education, health and care (EHC) plan- a letter from a relevant professional with the child`s name and date of birth regarding the EHCP awarded.
  • the child is in receipt of Disability Living Allowance [https://www.gov.uk/disability-living-allowance-children] Evidence – award letter for DLA
  • the child has left care under an adoption order, special guardianship order or a child arrangements order - a letter from a relevant professional with the child`s name and date of birth or special guardianship, adoption or residence order from the court.
  • the child is supported through a child protection plan or child in need plan. A letter from the lead Social Worker would be required as evidence.
  • Coventry SEND the child has a diagnosed syndrome, condition or disability that significantly affects the ability to access learning or has 12 months developmental delay in 2 or more out of the 4 areas of need. These are:
    • Communication and Interaction
    • Cognition and Learning
    • Social, Emotional and Mental Health difficulties
    • Sensory and / or Physical needs
      and
    • the child is accessing additional services provided by health or local authority professionals
  • Early Help support – the child is accessing additional services provided by health or local authority professionals and the total household income of £20,000 or less a year, after tax

Proof of the parent’s total household income for a year, after tax and a letter from the relevant professional will need to be submitted when applying

If parents are a non- UK citizen who cannot claim benefits

If parent’s immigration status says that they have ‘no recourse to public funds’, they may still get free childcare for their 2-year-old. They must live in England and their household income must be no more than:

  • £26,500 for families outside of London with one child
  • £30,600 for families outside of London with two or more children

They cannot have more than £16,000 in savings or investments.

Proof of evidence will be required when applying and the completion of a Self-Declaration Form [https://www.coventry.gov.uk/downloads/file/40360/nrfp-self-declaration-form] must be submitted onto the portal, along with copies of the parent’s Biometric Cards or Aspen Card.

Extended Entitlement (30 hours childcare) process

This funding is only available for 3 and 4-year-old children where working parents meet the eligibility criteria

Children in Foster Care accessing 30 hours of childcare

Foster Carers who work outside of their fostering responsibilities may be entitled to receive up to 30 hours per week of funded childcare. This is an increase to the universal entitlement to 15 hours childcare for children aged 3 to 4.

The child's Foster carer and allocated social worker will decide together, before making an application, that accessing these additional hours are consistent with the child's care plan and the foster carer meets the eligibility criteria for extended entitlement funding.

Please note the following:

  • Each foster carer (or lone foster carer) must earn at least the minimum equivalent of 16 hours per week at the national minimum wage or national living wage, for further clarification please access: https://www.gov.uk/30-hours-free-childcare [https://www.gov.uk/30-hours-free-childcare]
  • 30 hours is the maximum amount of hours that can be claimed. However, it is perfectly acceptable for the child to access fewer hours.
  • Hours must be taken over no less than 38 weeks, up to a maximum of 570 hours across the year
  • Foster Carers can choose to pay for additional hours above 30 per week if this is consistent with the care plan
  • Costs in addition to direct childcare e.g. food or nappies will not be covered by either the universal or extended hours entitlement funding
  • Coventry City Council is responsible for the generation of childcare codes for all eligible, Coventry Looked After Children. This includes children who either have a Coventry address or attend a Coventry childcare setting.

Foster Carers must apply inline with the time frames stated in the 30-hour process;

  • Before 31 December for a January start date
  • Before 31 March for an April start date
  • Before 31 August for a September start date.
  • All applications must be re-confirmed every three months by your social worker and Coventry Business Sufficiency and Funding Team, to ensure continued eligibility. Failure to reconfirm may result in the extended hour's provision being withdrawn, in line with the terms and conditions of the funding stream

Once a Special Guardianship Order (SGO) is granted, the carer then has the same right to benefits and tax credits as a birth parent. All Foster Carers who are granted Special Guardianship Order are then required to apply for 30 hour funding on the Childcare Choices website, [https://www.childcarechoices.gov.uk] the same as the birth parents.

Early Years Parent Funding Agreement 1 April 2024 - 31 August 2025

This form is to be completed by a parent or carer with legal responsibility for an eligible child, together with the chosen early years provider. Please review the details each term to ensure they are up to date before submitting your claim.

Making a funding claim after the termly headcount

Funding claims for 3 and 4 year-olds must be submitted to the Local Authority by a set date each term. This is known by the Private, Voluntary, and Independent sector (PVI) as ‘Headcount day’. Schools refer to this date as the termly ‘Census’.

Where children are not enrolled and attending by this date, they cannot usually access a funded entitlement place until the start of the next term, however, exceptions to this rule will be permitted in strict accordance with the following criteria:

The child is an eligible 3 or 4 year old who was not recorded on the providers termly headcount information because:

  • the child has recently arrived in the Country.
  • the child has recently arrived in Coventry, having resided somewhere else in the UK and has not claimed a funded place elsewhere, during the term for which the funding claim is being made.
  • Exceptional circumstances

What is the process called?

Formally known as the Late Starter Process, this updated process will be called PCH34 - (Post Census/Headcount Claims for eligible 3 and 4 year olds)

Who can use the PCH34 process?

This process is for use by schools, privately run Ofsted registered group settings and childminders offering early years funded entitlement places to eligible 3 and 4 year olds

Making a Post Census/Headcount claim for an eligible 3 or 4 year-old (PCH34)

Providers must seek approval from the Local Authority, prior to adding a child onto the Coventry Schools and Early Years Provider Portal Amendment Task.

Please note; payment will not be made where approval has not been granted through this process.

To request approval, providers will need to complete the online PCH34 online application form [https://myaccount.coventry.gov.uk/service/PCH34_application]. Once we have received your PCH34 application you will be contacted by a member of the Early Years Business, Sufficiency, Funding and Safeguarding team.

Where approval is granted, the provider will need to add the child’s details to the Coventry Schools and Early Years Provider Portal, via the Amendment task, when it opens.

Post Census/Headcount claim for an eligible 2-year-olds (PCH2)

The process for making a post census/headcount claim for children eligible for 2-year funding (PCH2) does not require approval from the Local Authority.

Making a PCH2 Claim

Upload the details of eligible children onto the Coventry Schools and Early Years Provider Portal via the ‘amendment task’ when it opens.

Please note: The amendment task is time limited. Once the task closes, eligible children will not be able to access a place until the start of the next funding period.

Additional Funding for 3 and 4-year-olds - Early Years Pupil Premium (EYPP)

Where parents or carers are found to be eligible, EYPP provides additional funding to the childcare provider. This funding supports the provision of additional resources to enhance the child’s educational experiences.  E.g., staff training or the purchase of additional resources.  Providers should ensure that the EYPP section of the Parent Funding Agreement is completed.

Disability Access Funding ( DAF)

A Childcare Providers Guide to Disability Access Funding (DAF)

What is Disability Access Funding (DAF)?

Disability Access Funding (DAF) is an additional annual payment that is made directly to a child’s Early Year’s Childcare Provider.  It is for eligible children with Special Educational Needs and Disabilities (SEND).  Disability Access Funding aims to help Childcare Providers make reasonable adjustments that support children with SEND to access their Early Education Entitlement.

Childcare Providers will receive an annual payment for each eligible child.  It is essential that Childcare Providers claim as soon as possible, as some children will be eligible for a second payment one year later if the child remains at the setting.

The payment facilitates Childcare Providers to make reasonable adjustments that support children with SEND to overcome barriers to participation.  This may include but is not limited to:

  • Paying for staff to access specialist training.
  • Purchasing specific resources which support a child with SEND.
  • Funding additional sessions

Which children are eligible to receive DAF?

Eligible children will be;

  • in receipt of the Universal Entitlement (15 hours) for 3-and-4-year-olds

and

Please note: 4-year-olds who are attending a School Reception Class place are not eligible for DAF.

Which Childcare Providers can claim DAF?

Any Childcare Provider who delivers Universal Entitlement funding can claim DAF for an eligible child. This includes;

  • Childminders
  • Day Nursery
  • Nursery Classes or other early years provision in schools
  • Pre-schools

What if a child attends two Childcare Providers?

If a child attends two different Childcare Providers to access their Universal Entitlement, e.g. 7 ½ hours per week with a Childminder and 7 ½ hours per week at a Preschool, Parents must nominate which Childcare Provider will receive the DAF payment.  This must be recorded on the relevant section on the Parent Funding Agreement.

How to submit a DAF claim?

  • Ensure the Parent complete the DAF section of the Parent Funding Agreement.
  • Obtain a copy of the child’s DLA award letter.
  • Submit the DAF claim via your Coventry Schools’ and Early Years Portal account.  You must upload a copy of the child’s DLA award letter. (Award letters must be returned to the Parent once you have made the claim)

Will I be required to transfer DAF if a child leaves my setting before the end of the year?

If a child leaves the nominated DAF Childcare Provider once the DAF payment has been made, the funding will remain with that provider. DAF is not transferable and does not follow the child.

How can I use DAF to support a child with SEND? 

You should identify what reasonable adaptations or resources may be required to support the child to have equal access to the early years provision, by removing barriers which impact on their participation.

You should liaise with Parents about their child’s needs and engage with relevant professionals to ensure the DAF is spent appropriately. Relevant professionals may include the child’s Portage Worker; Educational Psychologist, SEND advisor; Physiotherapist; Occupational Therapist; Health Visitor etc.  

If you have more than one child in receipt of DAF, you may combine the funding to support adjustments or purchases that will benefit more than one child. Where you make purchases or complete work in relation to adjustments that exceed the amount of funding provided by DAF, you will be expected to fund the shortfall.

Childcare Providers are expected to keep evidence of how they have spent DAF and the impact it has made for children in receipt of it. Evidence may be requested by the Local Authority or Ofsted at any time.

Tax-Free Childcare - Information for providers

Working parents who are eligible for Tax-Free Childcare can set up an online Tax-Free Childcare account to pay for childcare.

For every £8 a parent pays into their Childcare Account, the government adds an extra £2. Parents could get up to £2,000 per child per year towards their childcare costs, or up to £4,000 for a child with a disability.

Parents will only be able to make payment to a Childcare Provider if that Provider is signed up to Tax-Free Childcare.

While parents can't make payments using both Tax-Free Childcare and (Employer) Childcare Vouchers, Providers who are signed up to Tax-Free Childcare can receive payments from both schemes.

Signing up for Tax-Free Childcare

Childcare Providers will need to sign up to receive payments from parents. You must be a regulated or approved childcare provider to receive Tax-Free Childcare

If you are not already registered with a regulator or approved childcare provider e.g. Ofsted or a Childminder Agency, we recommend you do this now, so that your customers can pay you using Tax-Free Childcare.

To sign up you should be the main contact for your business. You’ll be able to set up a ‘delegate’ to manage your account for you during the process.

You’ll need your:

Managing your account

Using your account is quick and easy. You can use it to:

  • change your delegate information.
  • update your bank account details.

If you don't want to run your own account, you can give access to someone else (your delegate), who'll be able to manage your account on your behalf, including updating your details in that account.

How parents can find you

Once you've signed up to Tax-Free Childcare, parents can use the Childcare Provider Checker to search for you, using your:

  • name (the name you registered with your regulatory authority);
  • address or postcode;
  • regulator reference. For example, if you are registered with OFSTED this will be your Unique Reference Number (URN)

How parents make payments to you

Parents can use their Tax-Free Childcare account to make regular or one-off payments direct to your bank account. The payment should only take 2 to 3 working days to arrive in your bank account. When you receive a payment from a parent, this will include both their payment and the government contribution.

Tax-free Childcare payments have a reference number of 4 letters and 5 numbers, followed by 'TFC'. The letters are made up of the first initial and the first 3 letters of the surname of the parent making the payment. For example, AJON12345TFC. This will help you link the payment to a specific child.

Termination of Agreement to deliver Early Education Entitlement Places

Where a Coventry Childcare Provider no longer wishes to deliver Early Education Entitlement places, the Provider must complete the online ‘Withdrawal to deliver Early Education Funded places’ [https://myaccount.coventry.gov.uk/service/Withdrawal_to_deliver_Early_Education_Funded_places] form which serves as official notification to Coventry City Council.

This form is for use by Coventry Childcare Providers to inform us of their intention to be removed from Coventry’s Early Education Entitlement Funding register.

As a result of removing a Childcare Provider from the funding register, Coventry City Council will

  • Close the Coventry Schools and Early Years Portal Account
  • Remove the Provider’s email address from the Local Authorities distribution list for funded providers. You will therefore no longer receive emails in connection with funding related issues
  • Close the Providers account as a supplier so that they are no longer able to receive funding payments form the Coventry City Council

Repayment sums

As a result of your withdrawal to deliver Early Education Funded Places, the Provider Funding Agreement of which you signed governing the contractual arrangement between you and the Council will be terminated. In respect of termination the Provider Funding Agreement states:

In the event of termination of this Agreement pursuant to clause 18, the Provider is required to repay to the Council on a pro rata basis any sum of money received for the current Funding Period of which the Provider will no longer be providing Funded Entitlement Places.”

You will therefore be required to repay to the Council any money paid to you for Early Education Entitlement Places that you no longer deliver. The Council will inform you of the amount repayable in writing.

Provider Causing Concern Process ( PCCP)

Coventry’s Provider Causing Concern Process (PCCP) is a robust 4 stage process which aims to provide a package of intensive support to childcare providers, who are judged less than good, by Ofsted at inspection, or who have been asked to engage because they meet one of the additional criteria listed below. The aim of the PCCP is to support childcare providers to make swift and effective progress to raise the quality of provision, outcomes for children and achieve compliance with the statutory requirements for the delivery of early education funded places.

The Local Authority engage this process where providers fall into the following categories:

  • The childcare provider receives an inadequate or requires improvement Ofsted inspection outcome
  • Ofsted and / or the Local Authority are concerned about a safeguarding issue, or the quality of the provision being offered to children.
  • The childcare provider has not yet received a first inspection, but the Local Authority has concerns in relation to aspects of the provision.
  • The childcare provider has been set actions as the outcome of a Position of Trust (POT) meeting
  • The provider has failed to engage in the initial stages of the Early Education Compliance audit process
  • Following a second early education entitlement funding Compliance Audit, the childcare provider has not completed actions set by the Local Authority, within the agreed time scales and therefore has failed to comply with the requirements to deliver early education entitlement places.
  • The provider is a childminder who is registered with a Childminding Agency, who received an ineffective Ofsted judgement at their most recent inspection.

The stage that a Provider is required to engage at, is dependent on specific criteria. More details can be found in the individual stages’ documents (1 to 4 below)

Prior to entering the PCCP, a designated Officer will contact the Provider to notify them that the Local Authority requires them to enter the PCCP because they meet one or more of the triggers for concern. The Officer will explain which criteria the provider meets and why. This will be followed up by a letter from a senior member of the Provider Causing Concern Panel

Changes to Early Education Entitlements 2023 -2025

The financial support that is available to parents to help with the cost of childcare is increasing. These include major changes to make it easier for parents with childcare responsibilities to move into or take on more paid work. Starting from April 2024, existing childcare support will be expanded in phases.

The changes are being introduced gradually to make sure you can meet the needs of more families.

This means that:

  • From April 2024, eligible working parents of 2-year-olds will be able to access 15 hours childcare support.
  • From September 2024, 15 hours childcare support will be extended to eligible working parents of children from the age of 9 months to 3-year-olds.
  • From September 2025, eligible working parents of children under the age of 5 will be entitled to 30 hours of childcare a week.

Like the existing offer, these hours can be delivered across 38 weeks of the year (during school term time), or up to 52 weeks if offering a stretched model of delivery.
